Terms of Service
Welcome to LittleLit, a children's story reading app created by Coherence Technologies Inc. These terms of service ("Terms") apply to Coherence Technologies Inc. (the "Company", "we", "us", "our"), your access and use of "LittleLit App", "LittleLit", "App" (the "Service"). Please read them carefully. By accessing or using LittleLit, you agree to be bound by these Terms of service.
1. ACCEPTANCE OF TERMS
By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting the modified Terms on the App.
2. Content Ownership
All stories and/or content generated through LittleLit are the intellectual property of Coherence Technologies Inc. You acknowledge and agree that Coherence Technologies Inc. owns all legal right, title, and interest in and to LittleLit, including any intellectual property rights that exist in LittleLit. You hereby agree that Coherence Technologies Inc. has a perpetual, irrevocable, nonexclusive, royalty-free, sublicensable, fully paid, worldwide license to create derivative works from, access, reproduce, distribute, process, publish, display, perform, adapt, modify, analyze user content.
3. Copyright Notice
All stories and/or content generated through LittleLit App are the intellectual property of Coherence Technologies Inc. Any reproduction or use of such stories without the express written consent of Coherence Technologies Inc. is strictly prohibited.
4. User Data and Privacy
By using LittelLit App, you agree that Coherence Technologies Inc. may collect and use your data in accordance with our Privacy Policy, which is available on the App. This data may include non-personal information such as user behavior and device information.
5. OpenAI APIs Usage
LittleLit uses OpenAI APIs in the backend to generate stories based on queries provided by you. By using LittleLit, you agree that the stories generated were reviewed by you and you bear the responsibility of the content of the stories. You hereby agree to be bound by OpenAI's API terms of use and privacy policy
6. User Conduct
You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the App by any third party. You agree not to attempt to circumvent the App's security measures, or to request or use the App to generate inappropriate content. You also hereby agree to following terms on:
Account credentials: When you create an account, you hereby agree to maintain security of your account.
Age Restrictions: The app is intended to be used by adults (over 18 years) for generating stories for kids. By using the app, you confirm that you are 18 years and above.
Parental Consent: Children under the age of 13 are required to have parental consent before using the app.
Inappropriate Content: The app may not be used to request or submit any inappropriate or offensive content. We reserve the right to remove any content that we deem inappropriate or offensive, and revoke access of the user.
You hereby agree not to request queries and/or generate stories through LittleLit App for any of the following:
- Content that is libelous, defamatory, bigoted, fraudulent or deceptive;
- Content that is illegal or unlawful, that would otherwise create liability;
- Content that may infringe or violate any patent, trademark, trade secret, copyright, right of privacy, right of publicity, moral rights or other intellectual or other right of any party;
- Mass or repeated promotions, political campaigning or commercial messages directed at users who do not follow you (SPAM); and
- Viruses, corrupted data or other harmful, disruptive or destructive files or code.
- Also, you agree that you will not do any of the following in connection with the Service or other users:
Use the Service in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying the Service or that could damage, disable, overburden or impair the functioning of the Service;
- Impersonate or post on behalf of any person or entity or otherwise misrepresent your affiliation with a person or entity;
Collect any personal information about other users, or intimidate, threaten, stalk or otherwise harass other users of the Service;
- Create an account or post any content if you are not over 13 years of age years of age; and
- Circumvent or attempt to circumvent any filtering, security measures, rate limits or other features designed to protect the Service, users of the Service, or third parties.
7. Misuse of the App
Coherence Technologies Inc. is not responsible for any misuse of the app by users, including but not limited to the inappropriate requests for stories. Coherence Technologies Inc. reserves the right to block any user who misuses the app or who violates these Terms.
8. Subscription/Fees
All or some parts of LittleLit App are made available on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select.
You agree that at the end of each Billing Cycle, your Subscription will automatically renew and your payment method for such Subscription will automatically be charged at the start of each new Subscription period for the fees and taxes applicable to that Billing Cycle, under the same conditions as the prior Billing Cycle unless you cancel it.
A valid payment method, including credit card and billing information, is required to process the payment for your Subscription. By submitting such payment information, you automatically authorize Coherence Technologies Inc. to charge all Subscription fees incurred through your account to any such payment instruments.
9. Disclaimer of Warranties and Limitation of Liability
LittleLit and all stories generated through LittleLit are provided on an "as is" and "as available" basis. Coherence Technologies Inc. makes no representations or warranties of any kind, express or implied, as to the operation of LittleLit or the information, content, materials, or products included on LittleLit. You expressly agree that your use of LittleLit is at your sole risk.
Coherence Technologies Inc. will not be liable for any damages of any kind arising from the use of LittleLit, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.
10 . Indemnification
You agree to defend, indemnify and hold harmless Coherence Technologies Inc. and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees arising out of or relating to your use of LittleLit.
11. Governing Law
These User Terms and Conditions are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without giving effect to any principles of conflicts of law.
12. Amendments and Updates
Coherence Technologies Inc. may amend these User Terms and Conditions at any time by posting the amended User Terms and Conditions on the LittleLit app and on our website. Your continued use of LittleLit after any such amendments shall constitute your agreement to be bound by the amended User Terms and Conditions.
13. For users/visitors from European Union and/or European Economic Area
Currently, LittleLit App is not designed for users/visitors from European Union and/or European Economic Area and hence, as such LittleLit App is not designed to meet the GDPR requirements. Having said this, if you as a user/visitor from European Union and/or European Economic Area and still register for an account with LittleLit App, you acknowledge that you have knowingly signed up for an app which currently does not meet GDPR standards. Please refer to our Privacy Policy for more details.
14. Disclosure to Government and any other legal disclosures
We may be required to give information to legal authorities if they so request it. We reserve the right to disclose your information in the follow cases:
• As required by law such as to comply with a subpoena, or similar legal process
• If we think in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request,
• If Coherence Technologies is involved in a merger, acquisition, or sale of all or a portion of its assets. We will provide a detailed information about this to you via email and also through updates on our website.
